Terms of Service

1. Who we are

our4cuts is a product of Design ELF ("we," "us," or "our"), located at 18405 S Vermont Ave #304, Gardena, CA 90248. By subscribing to our4cuts or installing our hardware, you ("Venue" or "you") agree to these Terms.

2. The service

our4cuts provides an iPad-based 4-cut photo booth platform including: branded photo capture software, guest contact collection (email/SMS opt-in), automated weekly recap reports, social sharing prompts, and related support services. The platform is provided as-is via monthly subscription.

3. Subscription and billing

• Subscriptions are month-to-month, billed in advance on the same day each month.
• Pilot venues receive 25% off the first 3 months. Standard pricing applies from month 4 unless otherwise agreed in writing.
• You may cancel anytime. Cancellation takes effect at the end of the current billing period; no partial-month refunds.
• We reserve the right to update pricing with 30 days' notice by email.

4. Hardware kit

• The one-time hardware kit fee ($699 per device) covers the iPad, kiosk enclosure, stand, ring light, mount, cables, branded frame design, and on-site installation.
• Hardware supplied by Design ELF remains the property of Design ELF during the active subscription. We will recover the hardware if the subscription is cancelled or terminated.
• You are responsible for reasonable care of hardware while on your premises. Damage beyond normal wear may be billed at cost.

5. Acceptable use

The service is licensed for use at your registered venue(s) only. You may not resell, sublicense, or transfer access. You agree not to use the platform to collect data from minors under 13 without parental consent, or in any way that violates applicable law.

6. Guest data and consent

• Guests who opt in to email or SMS contact provide that information voluntarily, with a clear consent checkbox. Consent text has been reviewed by a California-licensed attorney.
• You are the data controller for your venue's guest contact list. Design ELF acts as data processor on your behalf.
• You agree to use guest contact information only for your own restaurant marketing, and not to sell or share it with third parties outside your business.
• Upon subscription cancellation, you will receive a final CSV export of your contact list. Design ELF will delete venue data within 90 days of cancellation.

7. Intellectual property

The our4cuts software, branding, and platform are owned by Design ELF. You retain ownership of your brand assets (logos, frames, hashtags) that you provide for use in the service.

8. Disclaimer of warranties

The service is provided "as is." We do not guarantee uninterrupted uptime, specific opt-in rates, or marketing outcomes. We will make reasonable efforts to resolve issues promptly.

9. Limitation of liability

To the maximum extent permitted by law, Design ELF's total liability for any claim arising from these Terms or the service shall not exceed the total subscription fees paid by you in the three months preceding the claim.

10. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

11. Changes to these Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance.
